Terms of Service

Funding Network operates a marketplace. We take your funding request to independent funding companies, who compete to fund it. You see their offers and choose among them.

To use Funding Network you must:

• Be at least 18 years old.
• Be an owner, officer, or authorized representative of the business you are applying for, with authority to bind it and to share its financial information.
• Be applying for funding for genuine business purposes, not personal or household use.
• Be located in the United States.

You are applying on behalf of a business. If you are a personally liable owner, you confirm that when you complete the credit authorization.

Funding partners rely on what you submit. You agree that the information you provide — about you, your business, your revenue, your existing funding positions, and the bank statements you upload — is true, accurate, and complete, and that you have the right to share it.

Submitting falsified documents or materially false information is fraud. It may result in immediate termination, and we may report it to funding partners and to law enforcement.

You must keep your account credentials confidential and tell us promptly if you suspect unauthorized access. You are responsible for activity under your account.

• Submitting an application does not guarantee funding. You may receive many offers, one, or none. We do not promise any particular amount, rate, term, or speed.
• Offers are made by funding partners and are subject to their conditions. An offer may be conditioned on verification, documentation (“stipulations”), or a final review. A funding partner may withdraw or change an offer before funding, and offers expire.
• Estimated figures are estimates. Any estimated APR, cost, time to fund, or payment figure shown on the platform is an estimate for comparison. The binding numbers are the ones in the funding agreement you sign.
• Accepting an offer is a commitment to proceed in good faith with that funding partner, including completing verification and signing documents.
• We may decline or remove any application — including for suspected fraud, ineligibility, or misuse — at our discretion.

You consent to do business electronically. You agree that your electronic signature on documents signed through the platform has the same legal effect as a handwritten signature, and that we and our funding partners may deliver contracts, disclosures, and notices to you electronically.

To access these records you need a device with a current browser, internet access, and a working email address. You may request paper copies or withdraw this consent by contacting us, though doing so may prevent you from completing an application.

When you submit your contact details, you authorize Funding Network and its funding partners to contact you about your application by phone, text message, and email — including by automated means. Message and data rates may apply.

This consent is not a condition of receiving funding. You can opt out of marketing email using the unsubscribe link and out of texts by replying STOP. We may still send you messages necessary to service an active application. Detail is in our Privacy Policy.

Our Privacy Policy explains what we collect and who receives it, and is part of these Terms.

The most important point: we share your application with funding partners so they can compete for your deal, and they receive it identified. Those partners are independent companies whose own privacy policies govern what they do with it.

Separately, you authorize us under the Fair Credit Reporting Act to obtain your credit information for pre-qualification. Pre-qualification uses a soft inquiry and does not affect your credit score.

You agree not to:

• Submit false, forged, or altered documents or information.
• Apply on behalf of a business you are not authorized to represent.
• Access, or try to access, data belonging to another user or funding partner — including competing offers you have not earned visibility into.
• Scrape, probe, reverse-engineer, or interfere with the platform or its security controls.
• Use the platform to broker deals for third parties without our written agreement.
• Use the platform for any unlawful purpose.

If you access the platform as a funding partner, you additionally agree that:

• Merchant information you receive is confidential and may be used only to evaluate and fund that specific deal — never for unrelated marketing, resale, or list-building.
• You will handle it in compliance with applicable law, including the Gramm-Leach-Bliley Act and the Fair Credit Reporting Act, and will maintain reasonable safeguards.
• You will use soft credit inquiries only, unless the merchant has given separate, explicit permission for a hard inquiry by you specifically.
• You will not attempt to view competing offers you have not earned visibility into under the marketplace rules.
• Offers you submit are made in good faith and you are able to fund them.

The platform, its software, design, and content are owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the platform for its intended purpose. You keep ownership of the information and documents you submit, and grant us a license to use them to operate the service as described in the Privacy Policy.

The platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for the conduct of funding partners — their underwriting, their pricing, their decisions, their handling of your information, or their performance under any agreement you sign with them. We do not guarantee that the platform will be uninterrupted, error-free, or secure against every threat.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from your use of the platform.

Our total liability for any claim relating to the platform is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred dollars ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Funding Network Markets Inc.and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the platform, your breach of these Terms, or information you submitted that was false or that you had no right to share.

You may stop using the platform at any time and may ask us to close your account. We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms or suspected fraud.

Termination does not affect any funding agreement already in place between you and a funding partner, or information already delivered to a funding partner. Sections that by their nature should survive — accuracy representations, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

We may update these Terms. If we make material changes, we will notify you and update the effective date. Continuing to use the platform after a change means you accept the updated Terms.
